Summary of the Terms of Use

To make your life simpler, here is a summary of our Terms of Use. Its purpose is to capture the essence of each of the sections of the Terms but does not in any way replace the full Terms and your agreement to the full Terms. Please refer to our entire Terms of Use to ensure you understand the details of this agreement.

The Terms of Use governs your use of any part of Trioova’s online platform. By accessing and using the platform, you accept and agree to the Terms of Use. If you do not agree, please do not access or use the platform. Do not use the platform for medical emergencies.  

Our Privacy Policy contains important information on how we handle your private personal information.

You must be 18 years or older, able to enter into a legal contract on behalf of yourself or other person you are representing, follow the terms of use, and provide true and accurate information, in order to use the platform. The platform exists to help you search, connect with, book appointments, and pay for services provided by independent health care Providers or Trioova’s Concierges. We may refuse to allow you access to the platform for any reason.

Our Providers are licensed and accredited by their professional governing bodies and are independent of Trioova to provide you with Health Services. Trioova and its staff, including Concierges, are not engaged in the practice of medicine or any other regulated health profession and can only provide Support Services. Trioova is not liable and does not provide any guarantee or endorsement for the Health Services provided to you by the independent Providers.

All Providers on the Platform are licensed and accredited to practice by the applicable regulatory authority. You can report a complaint about a Provider by contacting the professional regulatory college(s) in the province(s) where the Health Services were received.

Not all products and services described on the Platform are available in all geographic locations, can be construed as an offer or solicitation to buy or sell in places where it is against the law, or appropriate for use in all locations inside or outside of Canada.

You consent to Trioova collecting, using and disclosing your personal health information for the purposes of providing Support Services by Concierges or Health Services by Providers. These services are not intended to replace your pre-existing primary care relationships. You must ensure that you understand and consent to any kind of treatment received through Trioova’s platform and should refuse treatment if you do not understand or agree and consult with your primary care relationships if needed. You accept that there are risks associated with any treatment or services received through Trioova’s platform. Trioova uses advanced security measures to ensure your information is secure and protected, but you accept the inherent risks of technology. You will be informed as appropriate and legislated if a breach of information occurs.

When you use our platform, you consent to send and receive information electronically and we will communicate with you in a variety of ways electronically.

Subject to these Terms of Use, Trioova grants you a license to use the Platform, including downloading and installing the App on your personal mobile phone. In turn, you grant Trioova a license to access, collect, store, and use any data, information, records and files that you contribute or we retrieve on your behalf, to the Platform.

In order to use the Platform, you need a User Account which you will not share with anyone else or use to harvest any personal data of other users of Trioova. We reserve the right to disable a User Account at our sole discretion. Children may use Trioova’s services provided that the User Account belongs to the parent or legal guardian and you agree to comply with the Terms of Use on their behalf.

Trioova may provide services to you for free or charge transaction fees (Canadian Dollars) at our sole discretion, based on the current Fee Schedule, please contact privacy@trioova.zendesk.com if you would like more details about the current Fee Schedule. You are responsible for any taxes for services rendered. Trioova may require you to provide and maintain accurate details for a current and valid payment information, such as a credit card. By doing so, you authorize Trioova to charge any and all fees, charges or penalties that become due as a result of your use of the Platform.

“Submissions” are content on the Platform such as reviews, questions, comments, suggestions, ideas of similar information that you provide, excluding any personal health information. By providing a Submission you agree to allow Trioova to use this information for any reason both internally and publicly, and to allow your information to be associated with these Submissions. You agree that any Submissions you provide to the Platform are non-confidential and non-proprietary and that Trioova takes no responsibility or assumes liability for Submissions posted or submitted by you and you assume full liability for the content of your Submissions. Trioova reserves the right to deny submissions to be published at its sole discretion. Do not provide any Submissions if you do not agree.

All content on Trioova’s platform are owned and licensed by Trioova and protected by the content’s respective intellectual property laws. Trioova reserves all rights in the Platform and materials provided to you are owned by Trioova and are not to be considered sold to you.

You will use the platform in good faith and for its intended purposes and agree to not use the platform for any kind of unlawful or prohibited uses. Please refer to the “No Unlawful or Prohibited Use” section for specifics of unlawful or prohibited use.

Trioova will provide links to third party websites on the Platform but does not endorse or guarantee those websites for your use in any way. If you decide to access any third party website linked on the Platform, you do so at your own risk.

Downloading and viewing content on the Platform is done so at your own risk and we cannot guarantee that the content is compatible with your computer system or virus-free.

Trioova adheres to acceptable industry practices in securing the transmission of data to, from and through the Platform but does not guarantee the confidentiality of any communications made by you through the Platform.

Trioova strives to keep the content on our Platform as accurate and updated as possible, but errors and omissions may occur. Use of our Platform is at your own risk and we do not provide warranty or guarantees for any content on our Platform. Trioova will not be liable for any damages of any kind arising from your use of the Platform. You acknowledge that Trioova does not provide medical services and is strictly a technology platform and infrastructure for connecting patients with independent Providers. You accept that Providers have full authority, responsibility, supervision and control over any Health Services provided to you.

You will indemnify and hold harmless Trioova and all of its officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs and expenses as a result of: your breach of the Terms of Use, your violation of applicable laws, and your use of the Platform.

These Terms of Use and any disputes relating to the relationship between you and Trioova will be governed by the laws of the province of Ontario.

Trioova may change these Terms of Use and information, material, or content on the Platform from time to time without notice.

These Terms of Use will commence on the day you first use the Platform and continue into force until terminated by either party.
